Data we receive

When you write to hello@merki.studio or send the brief form, we receive the information you choose to send: your email address, name if included, website or tool URL, project context and message. The form delivers your answers straight to our intake system; if your browser cannot send them, it opens your mail app instead.

The website may also generate ordinary hosting logs needed for security, abuse prevention, debugging and availability.

The website records limited first-party interaction events such as opening the brief, trying the public demo, selecting a demo option or whether a brief submission succeeded. These events do not use analytics cookies, advertising pixels, hidden newsletter signup forms or cross-site advertising identifiers.

First-contact B2B outreach

If Merki Studio contacts a business by email, it may process professional data published by that business or by public directories: business name, website, professional email address, public source and a concrete observation about the website, booking path or contact flow.

The purpose is to assess whether there is a relevant B2B opportunity and, where appropriate, propose a private demo or a written conversation about that improvement. The basis for processing those professional details is legitimate interest, with priority given to corporate or role-based addresses and manual review before any send.

Commercial email sending is reviewed separately under Spanish LSSI rules and is limited to manual, low-volume batches with a concrete public trigger. Each message identifies the controller, explains the professional or public source of the data, includes an opt-out route and links to this page.

You can object or ask not to be contacted again at that mailbox by replying BAJA or writing to hello@merki.studio.

Purpose and legal basis

We use contact messages to reply, prepare a private demo, discuss a possible project, manage a commercial relationship and keep basic records of that communication.

The legal basis is the request you send before a contract, the legitimate interest in replying and protecting the website, and legal obligations where records must be kept.

Recipients and providers

Email, hosting and database providers may process data on behalf of the legal operator so the website, the mailbox and the intake system can work. Form submissions are stored in a database hosted in the European Union (Frankfurt).

We do not sell your data and do not pass it to third parties for their own marketing.

Retention

Project enquiries are kept for as long as needed to answer, follow up, prepare a proposal, manage the relationship or meet legal record-keeping duties. Form submissions that never receive a reply are deleted after 24 months.

First-party interaction events are kept for up to 13 months so the studio can understand whether the public demo, brief and SEO content are useful.

If there is no ongoing reason to keep a message, it can be deleted on request when no legal duty requires retention.

Your rights

You can ask to access, correct, delete, limit or oppose the processing of your personal data, and request portability when it applies.

To exercise those rights, write to hello@merki.studio from the address involved in the request.

You can also lodge a complaint with the Spanish Data Protection Agency (www.aepd.es) if you believe the processing has not been handled correctly.
